tendered registered Ch/s 537/19 on record. The chamber summons no. 537 of 2019
is taken out by the applicants to get themselves impleaded as legal heirs of deceased
defendant namely Guruprasad Satsangi. The deft has appeared and submitted that
he has no objection for bringing the legal heirs on record. The Summary suit 236 of
2015 is disposed of by exparte decree dated 18.11.2016 whereas the original
defendant Guruprasad Satsangi has filed NM 3574/17 for setting aside exparte
order and decree. The copy of death certificate reveals that the defendant namely
Guruprasad Satsangi has died on 16.11.2018 at New Delhi. The affidavit in support
of Ch/s reveals that it is made by the wife of the deceased defendant on 26.02.2019.
As such it is well within limitation. The defendant has also not objected the same.
Hence, it is necessary to bring the applicants on record as defendants no. 1A, 1B and
1C. Hence, the order as follows. ORDER 1. The Chamber summons no. 537 of 2019
is allowed. 2. The applicants are allowed to be impleaded as applicants (defendants)
no. 1A, 1B and 1C being the legal heirs of deceased defendant in N/m no. 3574/17.
3. Applicants in N/m 3574/17 to carry out necessary amendment in N/m 3574/17
within 15 days. 4. Chamber summons is disposed of accordingly.
