1. I have perused the contents of the plaint. According to the plaintiff he has advanced financial assistance to the defendant by way of business loan on interest. The Load advanced by the plaintiff to the defenant is in essence an act of Money Lending. There is no pleading about any money lending license which is issued in favour of the plaintiff. Therefore, it prima-facie appears that plaintiff is not in the Legal business of licensed money lending hence, the dispute between the parties is not covered in the definition of “Commercial Disputes” as given in Section 2(1) (c) of the Commercial Court’s Act, 2018.
2. That in view of the above discussed position, the present suit is not triable as a Commercial Suit hence, the registry of this court is hereby directed to re-register the suit and assign the matter to some other court other than a Commercial Court. Perused chamber summons and affidavit in support thereof. Chamber summons is served on the defendants. They failed to file their reply. Heard Ld. counsel for plaintiff. It is the contention of the plaintiff that Bimraj B. Sanghavi(HUF) had filed present suit through Mahendra B. Sanghavi as a Constituted Attorney. However, during pendancy of the suit, Bimraj B. Sanghavi(HUF) expired on 29.07.2022. Therefore, now Mahendra B. Sanghavi has become Karta and Manager. Therefore, it is necessary to bring him on record. Further, applicant was in shock due to demise of his elder brother and therefore, there is delay to take out this Chamber summons. It is pertinent to note that applicant has filed photocopy of death certificate of Bhimraj B. Sanghavi. Plaintiff ought to have taken out this Chamber summons within 90 days. However, it appears that there is nearabout six months delay. The applicant has given only reason due to demise of his elder brother, he was in shock. I am of view that this reason is sufficient, cogent and satisfactory to consider delay. Further, right to sue survives. If Chamber summons is allowed, no prejudice would cause to the defendants. Hence,
Hence, I proceed to pass following order-
Order
1. Chamber summons No.953 of 2023 is hereby allowed.
2. The plaintiff is directed to carry out proposed amendment, as per schedule annexed to the chamber summons within 14 days.
