heard ld. Shri Lotlikar advocate for the proposed legal heirs of the plaintiff.
As mentioned earlier, despite service, nobody appeared for deft no.2 to contest the Ch/s. The statements made in the affidavit filed in support of the Ch/s about causing death of plff Mahadeo on 24.10.2020 is supported by the copy of death certificate. Since there is no resistance to the Ch/s from the side of deft no.2, Ch/s No.841/2021 is allowed.
Amendment as per the schedule shall be carried out within two weeks from today.
Perusal of the affidavit of service shows that Ch/s No.368/2020 is not properly served on the HLRs of deceased deft No.1. Adv. for the plff submitted that proposed legal heir No.1 has accepted service of all the legal heirs. There is nothing in the affidavit of service to substantiate his said argument. Plffs to serve the proposed legal heir properly with Ch/s No.368/2020.

Statement made in the affidavit filed in support of the Ch/s about causing death of deft No.1 is supported by the copy of death certificate produced on record by adv. for deft No.2 with pursis Exh.3. The copy of death certificate shows that deft No.1 expired on 21.05.2019. There is no resistance to the statements made in the affidavit filed in support of the Ch/s. The proposed heirs are the only HLRs of deceased deft No.1 hence, Ch/s no.368/2020 is allowed as prayed.
Plff to carry out amendment as per the schedule within 2 weeks from today.
