                                        ORDER
      Perused plaint, documents tendered by plaintiff, prayers made in the N/M and heard Ld. Advocate for the plaintiff. On 21.02.2020, plaintiff was directed to serve the N/M to the defendant and accordingly, the plaintiff has tendered affidavit of service of the N/M to the defendant on 24.02.2020. Despite service, the defendant has not turned up today.
         Coming back to the facts of this case, the plaintiff has tendered Memorandum of Understanding between the parties, husband and wife, dated 21.03.2016 whereby the defendant agreed to gift the suit flat in favour of the plaintiff in exchange of the latter gifting other 1BHK flat in the same vicinity to the defendant. According to Ld. Advocate for the plaintiff, the defendant is not performing the part under the said MOU and now she has given threats to dispossess the plaintiff from the suit flat. The possession of the plaintiff over the suit flat can be seen from the cause title of the P.A. No. 303/2010 before Family Court, Pune wherein the present plaintiff\''s address is mentioned by present defendant is that of the suit flat. Moreover, other communications in writing between the parties also support possession of the plaintiff over the suit flat. Ld. Advocate for the plaintiff has shown letter dated 20.01.2020 of the Society whereby his application for car parking space was rejected on the ground that the suit flat was standing in the name of the defendant. Considering all the above aspects, plaintiff is entitled for ad-interim relief. Hence ad-interim relief in terms of prayer clause (a) and (b) is granted till next date.
