The Court Receiver submitted that he has taken steps in the
matter and will require at least six weeks time by
completing sale proceedings by publication and inviting
bids etc. Ld. counsels have no objection for grant of time to
Court Receiver. Ld. counsel for the applicant in CS prayed
for hearing and order on CS. Ld. counsel for other parties
have no objection for imp-leading the applicant in CS as
party defendant in the suit, with liberty to the applicant in
CS to move the court thereafter for other reliefs. In view of
the above, prayer clause (a) of CS no. 518/19 is allowed.
The applicant in CS is granted liberty to move the court
regarding other relief after his impleaded as defendant in
the suit. The plaintiff is directed to carry out necessary
amendment in the plaint accordingly within two weeks.
Copy of amended plaint be served on the other parties. CS
518/19 is disposed of accordingly.
