Read Chamber summons, affidavit in support of it and say of
defendant.
Heard respective counsel for parties.
Chamber summons is taken out for deletion of name of Plaintiff
no.1(d) from cause title of the plaint on the count that she died on
28.12.2018.
Copy of death certificate shows that Plaintiff no.1(d) namely Geeta
Janardan Joshi died on 28.12.2018. Chamber summons is taken out
on 01.03.2019 i.e. within period of 90 days from the date of death of
Plaintiff no.1(d). So, chamber summons is taken out within time.
L.Rs of Plaintiff no.1(d) are already on record, so I am inclined to
allow chamber summons. Hence pass following order.
ORDER
1. Chamber summons No.506 of 2019 is allowed and made absolute
in terms of prayer clause (a).
2. Plaintiffs to carry out amendment in cause title of the plaint within
two weeks from the date of order.
3. Accordingly, chamber summons is disposed off.
