roznama even before the lock down shows that
specific directions were given for placing of registered
CH/S on record but is not done. The leave to register
CH/S was obtained on 01.03.2019 and since then it is
not placed on record. Matter is KB for passing further
orders. KB LO at 4.27 p.m. Adv. Shaunak Bhatt for
the plaintiff is present. Mr. Omkar Sawarkar Legal
Officer Adani Electricity present. Today the plaintiff
has tendered original registered CH/S no. 498/19.
Order below CH/S no. 498/19 Perused the Chamber
Summons which is supported by an affidavit executed
by Shridhar Shetty. Heard Adv. Bhatt for the plaintiff.
Omkar Sawarkar for Adani Electricity. It is submitted
that the original defendant Reliance Energy Ltd. is
have been taken over by Adani Electricity, Mumbai
Ltd. Considering the said fact and as there is no
objection from the Adani Electricity, the Chamber
Summons needs to be allowed for continuing the suit.
Hence, I pass the following order- ORDER CH/S no.
498/19 is allowed and made absolute in terms of
prayer clause (a). The plaintiff is carry out the
amendment within two weeks and shall supply the
copy of amended plaint upon the new defendants
within two weeks thereafter. CH/S is disposed of
accordingly.
