ORDER
Perused Chamber Summons alongwith affidavit.
Heard Ld.Counsel for plaintiff.
Plaintiff taken out Chamber Summons on the ground that
Mr.Nikhil Kumar Sarkar the and then Chief Manager of the
plaintiff bank who had verified the plaint has been retired from
the service of plaintiff bank long back. It is further submitted that
Mr.S.Chandra Sekar is present A.G.M.of the plaintiff bank. In view
of above circumstances, the present name of officer may be
incorporated in the clause title of the plaint.
After perusal of record, initially Mr.Nikhil Kumar Sarkar
verified the plaint on 17/3/2004 and thereafter he was retired
technically it was upon plaintiff bank to incorparte the name of

present officer is required to be necessary therefore, the proposed
amendment is formal in nature and if permission is granted to the
plaintiff to incorporate the name of present officer then no
prejudice would be caused to the case of defendant. In view of
above said circumstances, I proceed to pass following order.
ORDER
1. Chamber Summons No.360 of 2020 is made absolute in terms
of prayer clause (a) and (b).
2. Plaintiff is directed to carry out amendment as per schedule
within 14 days.
