of documents filed by the plaintiff along with his evidence.
On 16-11-2018 the matter was dismissed in default for
want of presence of plaintiff . However, the earlier stage
was for filing reply by the defendant. Therefore, the
absence of the plaintiff was not material till such reply was
filed by the defendant. The instant NM is taken out on 17-
12-2018 and it was registered on 04-03-2019 . There is no
delay in filing the NM. Therefore , NM No. 910/19 is
allowed and suit No. 3554/09 is restored to its earlier stage.
The plaintiff to inform the defendant about the restoration
of the suit and the next date for filing say on the documents
i.e. 28-04-2020. Adjd to 28-04-2020 for filing say on the
documents.
