Suit No.7572 of 2002 pending in Court Room No.2 at Main Branch has filed this application seeking transfer of the said matter to Dindoshi Branch on the ground that Defendant No.1 is old aged person residing in Suburbs and that even otherwise territorial jurisdiction, would vest with Dindoshi Branch. Respondent/plaintiff has opposed the application stating that recording of evidence has not yet commenced, however the matter is at the stage of exhibiting the documents and at this stage, transfer is sought. 3. Today, both sides appeared and contested the application. Even otherwise, since the said suit has been transferred from the Hon'ble Bombay High Court, and as such, pursuant to the notice issued by the Registrar (O.S.)/ Prothonotary and Senior Master, High Court Mumbai on 16.4.2014, such matters could be transferred only if all the contesting parties agree for transfer.
