the parties are verified. The counsel for plaintiff and
defendants no. 1 to 2 and their counsel expressed that they
have read the consent terms and signed by the parties
before the mediator. They prayed for disposing of the suit
in terms of consent terms. It is informed by Ld. Counsel for
plaintiff that D-3 is a co-operative housing society and the
formal party in the suit and plaintiff is not seeking any
relief against D-3 in view of the compromise between
plaintiff and Defendant no. 1 and 2. Order 1. The suit is
disposed of in terms of consent terms- Exh.5. Consent
Terms dated 27.06.2019 shall be part and parcel of the
decree. 2. Decree be drawn up accordingly. 3. Court fee be
refunded as per rules. 4. No order as to costs. 5. Suit is
disposed of as settled by the parties before mediator. Notice
of motion no. 2478/18 is also disposed of as infructuous, in
view of compromise between the parties.
