Order Below Exh.1 and Exh.10
Representative of plaintiff and his counsel are present. The
counsel for defendant is present. The matter war referred for
mediation. The mediation report received vide letter dated
26-02-2026 at Exh.08 along with consent terms filed by the parties.
The consent terms is marked as Exh.09. The representative of
plaintiff today filed an application of withdrawal of present suit as
matter is settled between plaintiff and defendants in view of
consent term at Exh.09. He further submitted that, he does not
want proceed with the matter. The consent terms are read and
recorded. The plaintiff has admitted the contents of consent term at
Exh.09. It appears that, the plaintiff has received an amount
Rs.1,65,000/- towards full and final settlement by defendant no.1
Thus, considering the submissions of the representative as well as
contents of consent terms at Exh.09, as matter is settled between
the parties, I am of view that, the present suit needs to be disposed
off in view of consent terms at Exh.09. Hence, I proceed the
following order.
ORDER
1. Application at Exh.10 is allowed.
2. The Summary Suit No.1226/2017 is disposed off as withdrawn in
view of consent terms at Exh. 09.
3. Pending Summons for judgment No.200/24 is disposed of
accordingly.
4. The plaintiff is entitled for refund of court fees, if any, provided
for as per rules.
