1. Chamber summons No. 244 of 2020 is made absolute in terms of
prayer clause (a).
2. Plaintiff to carry out proposed amendment in the plaint within 14
days.
3. Chamber summons No.244 of 2020 is disposed of accordingly.
Record shows NM No. 1761/14 was filed by plaintiff on 30.04.2014.
Further roznama Dtd. 02.05.2014 shows requests for ad-interim relief
rejected by passing detail order. Thereafter, said NM has been
registered. Further roznama shows, after 02.05.2014 said NM No.
1761/2014 is pending as it is for same stage and no effective steps
taken by the party since last more than 10 years. So considering the
stage of matter, it is just and proper to decide the main suit as early as
possible. Therefore, NM No. 1761/2014 be merged with main
claim/suit. So, for statistical purpose notice of motion No. 1761 of 2014
stands disposed of.
Record shows NM No. 886/20 was filed by plaintiff on 11.02.2020
for ad-interim relief. Record shows requests for ad-interim relief
rejected on 21.02.2020 by passing detail order. Thereafter, said NM No.
886/20 is pending as it is for same stage and no effective steps taken by
the party. So it be merged with main claim/suit. So for statistical
purpose notice of motion No. 886 of 2020 stands disposed of.
