896/19. Advocate Mr. A. R. Pande for plaintiff filed
additional affidavit and contended that plaintiff wants to do
only plastering, painting, change of electrical wires,
plumbing, and change of tiles of flooring. Plaintiff is seeking
permission from the court only because of the dispute is
pending. Advocate Mr. Tavakkuli for the defendant/BMC
submitted that main motion is for hearing and he opposes to
the present motion. However, advocate Mr. Pande submitted
that he will not seek any equity in respect of granting of the
permission in main motion. The plaintiff is seeking
tenantable repairs. Admittedly no permission of the court is
necessary for the tenantable repairs. Hence, in view of the
statement of advocate for the plaintiff NM No. 896/19 is
disposed of. Defendant-corporation is directed not to take
any coercive action till next. Adjourned for NM hearing to
11.03.2019. Judge
