It appears that the plaintiff has taken out the present Chamber Summons for amendment in the plaint as per schedule. On going through the said schedule, it appears that plaintiff wants to write the word A partnership Firm and wants to amend the address, of plaintiff and bring new address on record. So also want to correct the grammar as mentioned in the schedule. The defendants have not point out that if the said amendment is allowed, what prejudice would cause to them. It appears that the said amendment is just and necessary to bring on record, for the purpose of deciding the real dispute in controversy between the parties and to avoid any ambiguity in the pleadings in plaint. It is true that there is some delay in moving the Ch/s, but it can not be a ground to reject the said amendment. Hence Ch/s no.335/18 is allowed, subject to cost of Rs.2500/- payable by the plaintiff to defendant, on or before the next date, without failed. After payment of the cost amount, the plaintiff is at liberty to carryout the purpose amendment in the plaint as per schedule and thereafter plaintiff shall submit the amended copy of plaint to the Court and to serve the copy upon defendant.
