Perused roznama. Both parties are absent. plaintiff had taken
out Summons for judgment No.254/18 on 07.08.2018.
Defendant No.2 failed to file reply to Summons for
judgment. Therefore, order passed to proceed ex-parte
hearihng on 19.09.2022. The matter is pending for hearing
on Summons for judgment since 25.01.2023 till today. The
plaintiff was given ample opportunity to file original
documents and hearing Summons for judgment. As plaintiff
failed to file original documents, matter was adjourned to
dismissal order on 15.06.2024. On that day, plaintiff filed an
application for removal of caption dismissal with submission
that he will file original documents on next date. However,
till today, plaintiff has failed to file original documents and
hearing on Summons for judgment. It appears that plaintiff is
not interested in conducting the matter. Therefore, no
purpose would served by keeping the matter pending. Hence,
I proceed to pass following order:-
Order
1. Sum. Suit No.353 of 2018 is dismissed in default for
want of prosecution.
2. Pending summons for judgment No.254/2018 is
disposed of, as suit is dismissed in default.
