Following order is passed on chamber summons no.
354/2020. Order- Plaintiff has taken out present chamber
summons for allowing him to amend the plaint as per
schedule. Perused the chamber summons, affidavit in
support of chamber summons and record. Heard ld.
Advocate for plaintiff. As defendants and their advocate
were absent, they could not be heard. From the matter on
record, it appears that, the proposed amendment is in the
nature of explanation to the pleading and plaintiff want to
incorporate the subsequent events which occurred during
the pendency of the suit. It appears that, by the present
amendment plaintiff also wants to add new prayers in the
plaint and want to prayer clause (a) and (d) of the plaint.
Considering the nature of the suit, proposed amendment
appears necessary for adjudication of real controversy
between the parties. No prejudice is likely to be caused to
the defendants as the trial is yet not commenced. There
appear no malafide on the part of plaintiff. Considering the
matter on record and above discussion, present chamber
summons deserves to be made absolute. Hence, court
proceeds to pass the following order. ORDER 1) Chamber
Summons No. 354/2020 is made absolute. 2) Plaintiff shall
carry out the amendment as per schedule within 14 days
from the date of this order. 3) Chamber Summons No.
354/2020 is disposed off accordingly. Matter adjourned for
compliance to 17/11/22.
