Pdf Text: Adv. Ravindra Singh for plaintiff present. Adv Pathak H/f Adv Kandekar present for
MHADA Read the application no say filed by the other party. The plaintiff have filed this
application for permitting him to amend the plaint and add the party to deft.no. 8. He
further submitted that the deft.no. 8 got executed sale deed in his favour from deft. no. 1 of
the suit property on 20.01.2017 and deft. no. 8 have no right to transfer the suit property.
Therefore, the deft.no. 8 is necessary party as well as proper party in the suit. If the deft.
no. 8 could not made party in the suit very purpose of the suit will be frustrated. Therefore,
pray for joint the purchaser as deft.no. 8 and may be allowed to carry amendment in the
plaint. After service of the notice no reply filed by the other party considering nature of the
suit and to avoid the multiplicity of the suit the plaintiff satisfied the court. The purchaser is
the necessary party in the proceeding. Therefore, I proceed to pass the following order 1.
Ch/s No. 453/2019 made absolute. 2. Plaintiff is directed to carry out amendment in the
plaint as prayed before the next date. 3. No order as to cost.
