ORAL ORDER
This chamber summons is taken out by applicant Mrs.
Yvonne Rose Jones for bringing the legal heirs of original deceased
plaintiff on record. This chamber summons is supported by an

affidavit. It is submitted that vide letter dated 30th June, 2017 the
learned advocate for plaintiff inform to the applicant that original
plaintiff Bansraj Laltaprasad Mishra has expired on 15th December, 2016
and also intimated the names of legal heirs. As the notice of motion is
pending therefore, for continuation of the same, the applicant herein
needs to be permitted to amend the title of notice of motion no. 3075 of
2016. So that, the legal heirs of deceased plaintiff can be brought on
record. Considering overall circumstances, I pass the following order.
ORDER
1. Chamber summons no. 327 of 2018 is allowed and
made absolute in terms of prayer clause (a) .
2. The applicant to carry out the amendment within two
weeks and shall supply the copy of amended notice of
motion upon proposed plaintiff within two weeks
thereafter.
3. Chamber Summons is disposed of accordingly.
