ORDER
1. Perused the draft chamber summons taken out by applicant
for deletion of non applicants No. 5a, 5b, 6, 11 to 15 and for
substitution of the respective legal heirs of the deceased non applicants.
2. Advocate for non applicants has resisted the chamber
summons on the ground that he wants to controvert the contentions of
applicant in the main motion.

3. In view of the facts that, applicant has right to take
proceedings against representatives of the party against whom he can
proceed in view of Sec.146 of the Code of Civil Procedure, 1908, the
applicant needs to be permitted to carry out the amendment in terms of
deletion and substitution because of demise of some of the non
applicants. Hence, the order :-
ORDER
1. Draft chamber summons is allowed as prayed.
2. Amendment to be carried out as per schedule within
stipulatedperiod. Reverification dispensed with.
3. Draft chamber summons be registered for statistical
purpose.
