It is submitted that, it was notice u/s 3 (z) of slum Act issued by the defendant corporation to file reply in 24 hrs. plaintiff being illiterate could not file immediate reply. Accordingly corporation has passed the order 27.01.2020 . plaintiff filed reply on 05.02.2020. Hence, under principal of actual justice one chance given to plaintiff. By directing corporation to consider reply and pass necessary order.
Adv Khandagale strongly objected to giving any chance to the plaintiff as notice structure itself is unauthorized.
Heard both side.
It transpires from the pleading that the defendant has pass the order 27.01.2020 without considering reply of plaintiff to notice issued by corporation. It reveals that the reply has been received by the corporation on 07.02.2020. Considering fact and circumstance of case plaintiffs reply has to be consider by defendant/corporation. Accordingly defendant/corporation is directed to consider reply file by the plaintiff on merit. Defendant /corporation shall not take any coercive action against plaintiff till passing of order. Interim protection one week is granted,  if any, adverse order goes against plaintiff.
Accordingly, motion was disposed of.
