Plaintiff sought to add defendant No.7, the purchaser of one of the suit properties and also sought to declare the Sale Deed between defendant Nos.1 to 6 and 7 for the suit property i.e. Godown at plot No.308, L.H. 89, CSK Mandal, Kurla West, Mumbai-70 as null and void.
Perusal of the documents reflect that the transaction is after the filing of the suit. The purchaser of the alleged property appears to be a necessary party and hence I allow the CS in terms of prayer clause (a). However, amendment to be carried out in the plaint only.
Amendment be carried out within 8 days.
Plaintiff to supply the amended copy of plaint upon newly added defendant.
