Though the Plaintiffs pleaded that suit premises is protected as per policy of Government of Maharashtra, but the Plaintiffs have not filed any documents in support. Nothing has been filed by the Plaintiffs to show in what capacity they are residing in suit premises and whether they have permission for suit premises structure.
Besides it appears from the documents of the defendant that there is prima facie report in respect of service of notice and order. Further inspection reports also on record. Then defendant issued notice and passed order. Thus prima facie the defendant followed procedure established by law.
