The plaintiff has filed instant Chamber Summons for inspection of following documents referred by defendant in their Written Statement. (1) Record and proceeding of Suit No. 8498 of 1990, (2) Gift Deed dated 29.07.1960, (3) Gift Deed dated 13.11.2002, (4) Property card of suit property, (5) Title documents of suit property, (6) Correspondence with parties prior to the suit and such other documents that the defendants are relying. -- 1 of 3 -- CS.434/19 in Suit no. 911/2016 2 2. In pursuance of the aforesaid Chamber Summons, the defendant gave inspection of the record. The plaintiff submitted that in the Gift Deed dated 29.07.1960, there is a reference of Gift Deed dated 10.09.1937. But, the aforesaid Gift Deed is not shown to the defendant. The defendant submitted that they did not have copy of aforesaid Gift Deed. In my view, the party can put proper suggestion in the cross examination for non submission of the aforesaid Gift Deed, no prejudice would be caused to the other side. Hence, in view of that, the Chamber Summons is disposed off. : ORDER : 1. The Chamber Summons No. 434/2019 is hereby made absolute in terms of prayer clause. 2. The matter be posted for issues. 3.
