Heard.  Perused copies of documents annexed to plaint.  Disputed notice filed at Exh.F shows that it was issued on 19/12/2014 informing that Plaintiffs 3.8 X 2.8 meter area was going to be affected by road widening of Mulund-Goregaon road. Plaintiff has filed copy of reply dated 27/05/2015, however it is contended that after said notice and reply no further action was taken by BMC and all of sudden on 18/02/2019 some BMC officers informed Plaintiff that action of demolition of suit premises will be taken shortly, hence Plaintiff has approached to this Court.
Advocate Ms. Tondwalkar for BMC submitted that, concerned officer of BMC has not turned to the Court inspite of intimation about filing of this suit and Notice of Motion and therefore she is not in a position to inform the Court that whether eligibility of Plaintiff in respect of alternate accommodation is decided on the basis of notice dated 19/12/2014.  Considering the fact that disputed notice is issued long back before 4 years and now BMC officers are threatening Plaintiff to demolish suit premises and further considering fact that concerned BMC officer remained absent today, I find that ad-interim protection can be granted to Plaintiff, hence ad-interim protection in terms of prayer clause (a) of draft NM is granted till filing reply of Notice of Motion. It is made clear that after NM reply will be filed by BMC, NM will be decided on merits.
