Perused the CS which is on affidavit of Vidya Bhalerao the General Manager of F. E. Dinshow Charities.  Today the ld. Advocate for the defendant is present.  Heard advocate for the defendant.  On perusal of the proposed amendment, the pltff intends to incorporate names of the trusties.  I have perused the order dt. 22/12/2016 passed by assistant charity commissioner pursuant to the change report which is annexed to CS as per Exh. B.  Considering the change in court and order.  The proposed amendment is necessary as those new trusties are proper parties to the suit.  In my opinion no prejudice will be cause to the deft if the amendment is allowed.  Hence I pass the following order.
ORDER
1. CS No. 338/20 is allowed in terms of prayer clause (a) and (b).
2. Pltff to carry out the amendment within two weeks and shall supply the copy of amended plaint to the pltff within two weeks thereafter.
Matter is adjd to 04/07/2022 for compliance.
