O R D E R
1. Read the chamber summons.
2. Heard Ld.advocate on behalf of both the parties.
3. The plaintiff did not file reply to the chamber summons. It
appears that as the advcoate of the defendant was not in town, the
reply could not be filed. The contention is on the affidadvit and it is
reliable. Considering the contentions in the chamber summons

supported with the affidavit and in the interest of justice and
considering the shortness of delay, it is just and proper to grant a
opportunity to the defendant to file the reply on record. The delay
caused may be compensated in terms of money by paying the same to
the plaintiff. In these circumstances, the chamber summons deserves to
be allowed . Hence, order as follows is passed.
ORDER
1. The Chamber summons No.432/2019 is allowed as under:-
2. The delay caused to the defendants to file the reply/ leave to
defend is condoned and reply/leave to defend be taken on record
subject to costs of Rs.2000/- (Rs.Two Thousand only) to be paid to the
plaintiff by the defendants.
