O R A L O R D E R
This execution petition is filed for execution of judgment
and decree dated 15/02/2017 in L.C. Suit No.231/2014 passed by City
Civil Court, Mumbai. Record shows as per clause number 3 of the final
order of said judgment and decree, Deed of Rectification also executed
through Court Commissioner i.e. Advocate Shri. Mangesh A. Narvekar
and said Court Commissioner submitted compliance report Exh.4 on
08/02/2019. Original plaintiff/Decree Holder also filed pursis vide Exh.5
along with copy of Deed of Rectification dated 02/02/2019. After that
Original plaintiff/Decree Holder filed detail application Exh.6 along with
pursis Exh.7 stating therein that already Deed of Rectification has been
executed by defendant Nos.1 to 4 in favour of plaintiff through Court
Commissioner. So, prayed for this execution petition be disposed of by
giving direction to the original defendant No.5/MCGM to enter name of
plaintiff in record as lessee in respect of suit property. Therefore, in view of
contents in pursis Exh.7 filed by Original plaintiff/Decree Holder. I, pass
following order.
O R D E R
1. In view of execution of Deed of Rectification as per judgment
and decree dated 15/02/2017 in L.C. Suit No.231/2014,
question of keeping this execution petition on balance sheet does

not arise.
2. On production of copy of Deed of Rectification dated
02/02/2019, Judgment Debtor i.e. Municipal Corporation
Greater Mumbai (original defendant No.5) in L.C. Suit
No.231/2014 shall act to record the name of plaintiff as per
judgment and decree dated 15/02/2017 in L.C. Suit
No.231/2014
3. Execution Application No.47/2018 stands disposed of
accordingly.
