Advocate Mr. Kumawat for deft./MMC present along with
officer Mr. Prakash Sonawane (Jr. Engineer, B and F, G
South ward). Heard both the sides on ad interim relief. The
defendant had issued notice dated 4.2.2015 u/s 351 of the
MMC Act. Plaintiff has given reply to the notice but still no
speaking order is passed. It also appears that again
defendant gave notice under Section 488 of MMC Act
dated 14.2.2019. Plaintiff apprehends that on the basis of
said notice, defendant will demolish the suit structure.
Defendant MCGM is directed to consider the reply filed by
plaintiff and then pass speaking order. Till then and in case
of adverse order, two weeks thereafter defendant is directed
not to take coercive action in respect of the suit premises.
In view of this, suit and draft NM are disposed off. They be
registered for statistical purpose.
