Perused the CS and the affidavit filed in support of it. Heard the counsel for the plaintiff. It is submitted that the plaintiff was not aware of the death of the defendant and after coming to know about his death, immediately filed the present Chamber summons.
According to the plaintiff the defendant has left behind his wife Rajeshvari T.  Chaudhari and therefore, copy of the Chamber summons has been served on her as proposed LRs of  the deceased defendant. The plaintiff has filed the service affidavit of serving the copy of the Chamber summons on the proposed LRs by RPAD. Along with the service affidavit, the plaintiff has filed the copy of the postal acknowledgment to show that the Chamber summons has been duly served on her. Thus, despite serving the Chamber summons, proposed defendant failed to appear. Hence, I find sufficient grounds to allow the Chamber summons. Hence, Chamber summons No. 1650/2022 is allowed. The plaintiff to carry out the amendment in the title of the plaint as shown in the clause B and C of schedule.
The plaintiff to carry out this amendment on or before 21.11.2023.
No order as to costs.
