ORDER
The record reveals that the suit is of the year 2020. After five years, the plaintiff bank served the defendant by way of substituted service and since 24.06.2025, it is for ex-parte evidence. By filing draft Chamber Summons on 28.07.2025, plaintiff bank prayed for substituting the earlier branch manager. It was allowed on same day. On same day, evidence affidavit of Inderjeet Kumar was filed along with compilation of documents. The matter was kept for compliance i.e. for tendering disposed of chamber summons which plaintiff bank failed to comply. Hence, by an order Dt.04.03.2026, the predecessor kept the matter for dismissal for non compliance. It was not complied on 13.04.2026, 15.04.2026. Even today, the authorized representative of plaintiff bank and their Advocate are absent. They are absent since 17.02.2026. It seems that the plaintiff bank has lost interest in the suit and they are not diligent to comply the orders passed. Hence, this Court is left with no option but to dismiss the suit for want of compliance.
