dismissed. The Ld. Adv.for the plaintiff has also
submitted that the said notice of motion was
dismissed. Therefore, Notice of Motion No.
1086/19 being already dismissed on 04.07.2019 be
removed from the board. Order below NM No.
776/2020 Perused the notice of motion which is
supported by an affidavit of Adv. Shri. Shashank
Borade. It is the matter of record that the Adv.for
plaintiff could not remove the objection within
specified time. The record shows that some Court
fees were paid but balance Court fee could not
paid, due to ill health of mother of the plaintiff.
Today the Ld. Adv.for the plaintiff has made a
statement at Bar that the plaintiff will remove the
office objection and will pay the necessary Court
fees within four weeks from today. Considering
these submissions and for giving an opportunity to
the plaintiff for contest the suit on merits it is
necessary to set aside order dtd. 06.06.2018.
Hence, I pass the following order ORDER Notice of
Motion No. 776/2020 is allowed in terms of prayer
clause (a) subject to the condition that the plaintiff
shall remove the office objection and shall pay the
necessary Court fees as per rules within four weeks
from today. If the plaintiff complies the same, the
Board Department to do the needful. Notice of
Motion No. 776/2020 is partly allowed and
disposed of.
