Two identical suits namely Short Cause Suit Nos.5644 of 2003 and 5645 of 2003 are sought to be made over to the same Court. It is submitted by the learned Counsel for the applicants that the parties and the reliefs in both the suits are the same and that both the suits were in the same Court earlier. However, pursuant to administrative order one suit got separated. 2. Despite service reply is not filed. In the aforesaid circumstances, it would be in the fitness of things to make over the two suits to one Court. It is made clear that it would be the discretion of the Court as regards the manner in which the two suits are to be dealt with. In such circumstances, I pass the following order. O R D E R 1. Transfer Application No.41 of 2020 is allowed. -- 1 of 3 -- 1 Mohammed Iqbal Abdul Sattar & Anr. V/s. M/s. Mohatta Builders & Associates & Ors. 2. Suit No.5645 of 2003 is made over to the Court where Suit No.5644 of 2003 is pending.
