The C/S No.402/2019 is filed by the plaintiff seeking addition the
Official Assignee as party defendant. The affidavit of service the
said C/S is already filed on record. In spite of the service no body is
present for the Official Assignee, Hon'ble High Court Bombay.
The affidavit filed in support of C/S reveals that the defendant no.1
company declared sick Industrial Company by BIFR. So also
defendant nos.3 and 4 are also declared insolvent.
It is further contained that the Official Assignee, Hon'ble High Court
Bombay is incharge of the defendant nos.3 and 4 property and
therefore addition of proposed defendant in essential to prosecute
the suit.
In view of the above noted contention the C/S deserves to be
allowed.
Hence the order on Chamber Summon No.402/2019.
1)Chamber Summon No.402/2019 is allowed in terms of prayer
clause (a) which reads as under.
2)Plaintiff to carryout necessary amendment within 14 days from
the date of this order.
3) Plaintiff to tendered the amended copy on record.
4) Chamber Summons No.402/2019 is disposed of accordingly.
Matter is adj to 31/10/2022 for compliance.
