	Advocate for defendant Nos. 6(a) to 6(d) has filed present application for making correction in the recording of evidence. It is submitted that cross-examination of plaintiff was recorded on 26.07.2023 in which particular question was asked to witness “Whether you (plaintiff) have filed any litigation/Suits against Laxman Pacharane and Sushila Pacharane in respect of Stall No. 4/A from 1996 till filing of the present suit to which plaintiff No. 1 answered having not filed any suit”, and Hon’ble Court has recorded answer as under - “ I have not filed any suit against Laxman Pacharane and Sushila Pacharane in respect of Stall No. 4/A”. However, this Court has miss-out recording period “ from 1996 till filing of present suit” at the end of word “ Stall No. 4/A”. Hence, plaintiff prayed for inserting said portion in his evidence.
Advocate for the plaintiff strongly opposed the same by submitting that defendants are trying to change the evidence which has been recorded by this Hon’ble Court on 26.06.2023. Hence, application be rejected.
	Considering the rival submissions, it is pertinent to note that evidence of plaintiff was recorded on 26.06.2023 and it was recorded in open Court by giving dictation. Had there been any mistake while recording evidence, Ld. advocate for defendant ought to have pointed the same to the Court at the time of recording evidence only. Now, today he is praying for inserting certain portion in the evidence of plaintiff which can not be permitted. Hence, application (Exhibit 24) is liable to be rejected in the following Order.
