The reasons assigned by the defendant is the Cardiac ailment of Counsel. The Notice of Motion is apposed by the plaintiff. However, looking to the reasons assigned by the defendant, I am of the view, to condone the delay. If the delay is not condoned that would prejudice the right of the defendant to context the claim of the plaintiff. The inconvenience caused to the plaintiff can be compensated by awarding reasonable cost to the plaintiff. Thus, I proceed to pass the following order. -- 1 of 3 -- N.M.811/19 in S.C 206/18 2 : ORDER : 1. The delay of 256 days in filing Written Statement is hereby condoned subject to the cost of Rs. 2,000/ to be payable to plaintiff. 2. The Notice of Motion No. 811 of 2019 is disposed off accordingly.
