Statement in the affidavit filed in support of Ch/s about causing death of D-4 Pandurang on 29/03/2019 is supported by the copy of death certificate. Since the proposed legal heirs have failed to contest the Ch/s, being satisfied that cause of action is surviving against the proposed legal heirs after the death of D-4, the Ch/s No.320/2020 is allowed. Plaintiff’s shall carry out the amendment as per the schedule within 2 weeks from today and serve the copies of amended plaint thereafter on the legal heirs of D-4 so also, on the other defendants.
