ORDER
This chamber summons is taken out by the applicants i.e.
proposed plaintiff nos.1(a) to 1(f) for recording their names in place of
deceased plaintiff. This chamber summons is resisted on behalf of
defendant by filing his reply on chamber summons itself.
2. Read the present chamber summons, say filed on behalf of the
defendant and Affidavit of applicant no.2 Pavankumar Rambhaji
Kamble in support of this chamber summons. Heard arguments
advanced on behalf of both the sides at length. Perused record.
3. On scrutiny of the present chamber summons and affidavit of
applicant no.2 Pavankumar Rambhaji Kamble that plaintiff Rambhaji

Mahadev Kamble is expired on 18/03/2019. The death certificate to
that effect is filed on record. Reasons mentioned in the affidavit of the
applicant no.2 Pavankumar Kamble for condoning delay for taking legal
heirs of deceased plaintiff on record are satisfied. Therefore, I inclined
to allow this chamber summons. Hence, I proceed to pass following
order.
ORDER
1. Chamber Summons No.321/2021 is hereby allowed as prayed for.
2. The applicants and their advocate are hereby directed to carry out
proposed amendment within stipulated period.
3. Chamber Summons No.321/2021 is disposed off accordingly.
