Perusal the record and proceeding. The summary judgment pressed into service by the plaintiff perused the document tendered at Exh. 7 i.e. total 5 documents all documents are photocopies/zerox copies even without taking due care to attest as a true copies. Further perusal fo the record goes to shows that defendant filed admission and denial upon the documents tender by plaintiff/PW-1 vide Exh. 8 dt. 03.12.2021 and strongly resisted document at Sr. no. 1 is a which is a photocopy and not original. Further no leave of the court is taken. Photocopy is not a primary evidence hence, objected the document to mark as a exhibit.
So far as document at Sr. no. 2 is disputed by the defendant in para no. 6 of the written statement again the same objection about photocopy and primary evidence have been taken and objected to mark the said document as exhibit.
So far as the document at Sr. no. 3 is also seriously disputed taking the same objection being not a primary evidence and photocopy hence objected to mark exhibit. If it is so, none of the documents can be considered being no primary evidence/original documents have been tendered.
So far as the document at sr. nos. 4 and 5 reply dt. 07.01.2020 and rejoinder dt. 11.01.2020 those are also objected being not original tendered.
