Order below Chamber Summons No.319/2020:
Heard advocate for Applicant Intervenor and Advocate for plaintiff.
Perused the Chamber summons and the reply filed by the Advocate
for plaintiff. During the course of argument, Advocate for plaintiff
submitted considering the transaction between defendant no.1 and
the proposed party/Applicant Intervenor, the applicant steps in the
shoes of original defendant no.1 and thereby request of the applicant
Intervenor to add him as defendant no.4 be allowed though formal
objection is taken. Hence, considering submissions of advocate for
both parties though present CS is opposed by the plaintiff, considering
the submissions as above, CS No.319/2020 is allowed and disposed
of. The plaintiff is directed to add the Applicant Intervenor as
defendant no.4 and amend the plaint accordingly and to file the
amended copy of plaint and to serve the defendant no.4 with Suit
summons.
Matter is adjourned to 13.04.2026 for Compliance.
