JUDGMENT
1. This petition is filed by petitioners for appointment them as a
guardian of minor namely Arushi and Bhavya under section 8 of
Guardians and Wards Act 1890.
2. The facts in brief are as under;
Petitioner no.1 is the husband of petitioner no.2. Petitioners are
governed by Hindu law. The petitioners had a son Hitesh and his wife

Anita. Hitesh and Anita have daughter namely Arushi aged three years
and son Bhavya aged two years. Petitioners son Hitesh and his wife
Anita died on 09/05/2018 at Mota Umarda, Gujarat. Now Arushi and
Bhavya reside with petitioners. The petitioners are grandparents of
Arushi and Bhavya. The petitioner no.1 is only earning member of his
family and he is working as a Skilled Support Staff with the ICAR
Central Institute for Research on Cotton Technology, Government of
India. Petitioner no.1 gets salary of Rs.49,144/per month. Petitioners
are looking after minors. Now minors are to be admitted in school.
Petitioners being grandparents are fit to be appointed them as a
guardians. Hence, prayed to allow the application.
3. Public notice and citation are issued in daily news papers.
However, no one raised objection. Heard Ms. Kavita Sharama Advocate
for petitioners.
4. From the perusal of record, I find that Arushi and Bhavya are
minors and they are grandchildren of petitioner no.1 & 2. Minors are
now resided with petitioners and they are taking their care. Petitioners
wanted to admit minors in the school. It is submitted that there is no
property in the name of minors. As stated above, no one raised
objection inspite of public notice. Petitioners being grandparents of the
minors are fit persons to be appointed as guardians for welfare of
minors. Hence, petition deserves to be allowed so, I pass the following
order.

ORDER
1. Guardian Petition No.75/2019 is allowed.
2. The petitioners no.1 Mohan Mavji Katpara and
petitioner no.2 Smt. Champa Mohan Katpara are appointed
under section 8 of Guardian and Wards Act 1890 as the
guardians of minors Arushi Hitesh Katpara and Bhavya Hitesh
Katpara.
3. Guardian Petition No. 75/2019 is disposed off accordingly.
