O R D E R
This chamber summons came out on behalf of plaintiff for
making amendment in the plaint as well as in the notice of motion . The
defendant no.1/Municipal Corporation have resisted this notice of
motion by giving reply on the same notice of motion. The defendant
no.2 resisted this notice of motion by giving reply.
2. Heard both the Ld. Counsels on behalf of both the parties.
Read the present notice of motion and reply given on behalf of
defendants. Perused the record.
3. By way of this chamber summons, the plaintiff wants to

make the amendment in the plaint as well as in the reply. On scrutiny of
the chamber summons as well as reply given by both the sides, if this
chamber is to be allowed, the nature of the suit will not be changed.
Moreover, this proposed amendment will be help for deciding real
controversy in between the parties. Therefore, I inclined to pass the
following order.
ORDER
1. Chamber Summons No.281/18 is hereby allowed as prayed for.
2. The plaintiff and his advocate are hereby directed to carry out
proposed amendment as prayed within stipulated period.
3. Chamber summons no. 281/18 is disposed of.
