ORAL ORDER
This is a chamber summons taken out by plaintiff to record
legal heirs of defendant no.2 and to condone the delay of 75 days.
Heard ld. Advocate Adyanthaya for plaintiff at sufficient length.
2. None for defendant no.1 is present. Perused reply
submitted by defendant no.1(a). It is averred that plaintiff has
intentionally avoided to record the legal heirs within stipulated time. It
is requested to reject the chamber summons with compensatory cost.

3. It is to note that plaintiff and defendant are close relatives.
There are sufficient grounds mentioned in chamber summons to
condone the delay. Suit is 18 years old as per institution number before
the Hon'ble High Court, the Original Side. Considering all facts in total,
chamber summons is allowed.
4. Notices are duly served on both legal heirs of defendant
no.2 by R.P.A.D. The returned envelope are annexed by plaintiff with
service affidavit. Therefore, specific notice of suit summons is not
necessary to the legal heirs of defendant no.2. Hence the order :
ORDER
1. Chamber Summons No. 384/2019 is allowed, delay as
prayed is condoned.
2. Plaintiff to carry on amendment to record the legal heirs of
defendant no.2, on or before next date.
3. Ch/s No. 384/19 stands disposed off.
