1. Heard learned Advocate for the plaintif and learned
Advocate for the defendant corporation.
2. The plaintifs by this Chamber Summons seeks to amend
the plaint by bringing the subsequent facts on record. The
plaintif had proposed with the corporation to construct
western type W.C. in the suit building. The said proposal is
rejected by the corporation.
The plaintifs seeks to bring this fact on record.

3. The Chambers Summons is opposed by the
defendant/Corporation.
4. The amendment sought are subsequent facts which
would not change the nature of the suit would also not
prejudice the defence of the corporation.
In order to avoid the multiplicity of the suit, the
amendment sought needs to be allowed. In the result,
following order is passed.
ORDER
1. Chamber Summons No. 387 of 2019 is allowed.
2. The plaintifs to carry out the amendment in the plaint
within 14 days from date of order.
3. Chamber Summons stands disposed of.
