The present suit filed by the plaintiff for directions against
defendant/MCGM that he should not be dispossessed from the suit
premises without following the due process of law. Along with the suit
notice of motion was taken for temporary injunction and the predecessor
of this court has passed the order that no coercive action should be
taken against the plaintiff without following the due process of law and
defendant/MCGM to issue notice by giving fair opportunity of hearing to
the plaintiff and then take necessary action under the prevailing law
within a period of three weeks from today. Thus, taking into
consideration the nature of relief claimed and order passed by the
predecessor of this court on draft notice of motion. I think it, that the
said order is liable to made absolute. In the result accordingly following
order is passed -
ORDER
1. L. C. Suit No. 291 of 2018 is hereby disposed of with the direction to
defendant/MCGM that to follow the due procedure of law before taking
any action against the suit premises.
2. No order as to costs.
3. In view of disposal of suit, Notice of motion No. 513/2018 does not
survives, accordingly it is also disposed of.
4. Bill of costs be drawn up accordingly.
