The plaintiff relies upon the estate license plan of 1997 and the letter of Asst. Engineer (Estate) dtd. 30/04/2019. It shows that the North-West Side balcony on the 3rd floor is enclosed so far as other balconies are concern the NOC for revalidation for regularization of the other balcony, the proposal of the plaintiff is yet to be decided by the corporation. The plaintiff also has to be deposited the security for the breaches with the Estate Dept. The plaintiff has some merit in the contentions. The plaintiff is entitled for protection till the matter is heard by the regular court. The defendant corporation not to take coercive action in respect of notice structure till 18/02/2020.
