Oneza for defendant no.1,3 and 5 present. Adv. for defendant tendered registered N/M
No.707/2020. T.O.R Adv. for plaintiff tendered reply on N/M No.707/2020. T.O.R Heard both
the side on N/M No.707/2020. F.R.S.R following order is passed on N/M No.707/2020.
ORDER 1.Notice of Motion No.707 of 2020 is hereby allowed in terms of prayer clause (a)
subject of payment of cost of Rs2000 to the plaintiff, after payment of cost written statement be
taken on record. 2.Defendant to bear their own cost. 3.Notice of Motion No.707 of 2020 is
disposed off accordingly. Adv. for defendant made a statement that, she will comply with the
order today itself. She is allowed to comply the order during course of the day. It appears form
the service affidavit (Exh-6) that, defendant no.4 is serve with suit summons on 09/10/2019. In
spite of that, no WS filed by defendant no.4. Hence, suit to proceed ex-parte against defendant
no.4. Adv. for defendants made a statement that, she do not want to file written statement for
def.no.2 hence, suit to proceed without WS of def.no.2. Matter is adj to 15/06/2020 for framing
of issues. Later on at 3.50pm Compliance done. Adv.Shaikh Oneza for defendant no.1,3 and 5
tendered written statement. (Exh-7) Copy served to the other side.
