Order
1. This notice of motion is taken out by defendant Nos. 2
and 5 for condonation of delay in filing written statement.
2. It is the contention of the defendants that there is delay of
67 days in tendering notice of motion for the reasons mentioned in the
affidavit of service.
3. Other side has not filed reply to this. This shows that the
plaintiff has no objection in taking written statement on record by
condoning delay. Furthermore, in the interest of justice and
particularly, stage of proceeding, I am of the opinion delay needs to be
condoned. Accordingly, notice of motion is made absolute in terms of
prayer clause (a).
