3. This notice of motion is taken out for restoration of dismissed

dismissed in default. It is a matter of record that, on the next working

day that is on 5th February, 2018 itself present notice of motion was
taken out. The reasons mentioned in the affidavit , in my opinion
which is sufficient to restore the previously dismissed notice of motion,
For giving fair opportunity to the plaintiff to argue the notice of motion
on merits. Hence I pass the following order.
ORDER
1. Notice of Motion no. 489 of 2018 is allowed and
made absolute in terms of prayer clause (a).
2. Notice of motion no. 2246/17 be restored and it be
kept for hearing.
3. Notice of Motion is disposed of accordingly.
