Business : Heard Ld. counsel for the parties in NM No.477/2018. By
this notice of motion, D-1 and 2 are seeking condonation of
delay in filing written statement. There is a delay of 3
months and 10 days. The defendants have explained the
reasons for the delay in paragraphs no.2 to 5 of the affidavit
filed in support of the notice of motion. The averments
made by the defendants are uncontroverted as no reply has
been filed by the plaintiff. There is no reason to disbelieve
the cause for delay given in the affidavit. Hence the delay is
liable to be condoned. However, the plaintiff is entitled to
cost from the D-1 and 2. Hence notice of motion no.
477/2018 is made absolute in terms of prayer clause (a)
subject to the payment of cost of Rs.2000/- to the plaintiff
within two weeks. If the cost is paid, the written statement
be taken on record.
